Acceptable Use Policy

Plain-English summary: Don't use Sparky Builder to make or run anything illegal, harmful, deceptive, or abusive — and don't try to hog or break the system. Break these rules and we can suspend or remove your access.
This Acceptable Use Policy ("AUP") is part of our Terms of Service and applies to everyone who uses Sparky Builder ("the Service"). It covers both how you use the Service and what you build with it.
1. Prohibited content & activities
You may not use the Service, or build/host apps that, do any of the following:
- Break the law or facilitate illegal activity.
- Infringe intellectual property, privacy, publicity, or other rights.
- Malware & deception: create viruses, spyware, ransomware, phishing, fraud, or deceptive/“dark pattern” functionality.
- Harm people: harass, threaten, defame, or promote violence, self-harm, or hate against any group.
- Exploit minors in any way, including CSAM.
- Sexual / adult exploitation content involving non-consent or minors.
- High-risk uses where a failure could cause death, injury, or serious property/environmental harm (e.g., medical, aviation, nuclear, weapons control) — the Service is not designed or warranted for these.
- Spam / unsolicited messaging or anything that violates anti-spam laws (including CASL or CAN-SPAM).
- Surveillance of individuals without lawful basis and consent.
2. Protecting the Service
You may not:
- Overload, flood, or abuse compute/hosting resources, or use the Service in a way that degrades it for others.
- Use automated means to consume resources beyond your plan's limits, or circumvent usage caps, rate limits, or billing.
- Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure.
- Reverse-engineer, scrape, or resell the Service except as expressly permitted.
- Probe, scan, or test the vulnerability of the Service without our written permission.
3. Your responsibility for hosted apps
If we host an app for you, you remain responsible for its content and conduct, including compliance with this AUP, app-store policies, and applicable law. We may remove or disable hosted content that violates this AUP.
4. Reporting abuse
To report a violation, email info@nimpact.ca with details. We investigate credible reports.
5. Enforcement
We may investigate suspected violations and may suspend or terminate access, remove content, or disable hosted apps — with or without notice — to protect the Service, other users, or third parties, or to comply with law. Serious or illegal violations may be reported to authorities.
